The current million dollar question is, is CBD legal?

Whether Cannabidiol (CBD) and Tetrahydrocannabinol (THC) are both legal substances, have been constantly up for much debate for quite some time now. THC is often categorized or grouped in with marijuana when it comes to legality purposes.

To date, medical marijuana is legal in 28 states plus Washington, D.C. However, the purchase and use of THC is still an extremely unclear area and really only applies to states that have already made medicinal or recreational marijuana legal.

Most of the states where medical and recreational marijuana is available, the average person already has access to Cannabidiol (CBD) infused products. Although CBD does not contain any THC, there is a constant debate as to the legality of cannabidiol, especially as CBD is a by-product of industrial hemp.

Although marijuana and all of the derivatives are not legal federally, there is an understanding that products made from hemp with minimal to no trace amounts of THC fall into a different category of regulation as a byproduct of the hemp plant.

Therefore, when purchasing and using CBD products including CBD oil, there are still questions of the legality.

Why is CBD Legal in Some States?

Cannabidiol (CBD) is a common compound found in the Cannabis Sativa plant, otherwise known as marijuana. Although Cannabidiol is found in the Cannabis Sativa plant and comes from the same cannabis species as marijuana, Cannabidiol is derived from hemp.

This strain of the hemp plant has a different classification because of the plant’s low level of tetrahydrocannabinol or THC, which is the active chemical in marijuana that gives marijuana users the “high” feeling.

Due to the fact that hemp plants do not possess the psychoactive properties, they are classified differently under the law. As a result of not containing THC, CBD is often considered an herbal supplement.

THC vs CBD

The end result is hemp that contains THC can be controlled in some states and be considered for medicinal uses, while CBD does not require the same rules and regulations.

To go even further, the Drug Enforcement Administration (DEA) on several occasions have attempted to classify both THC and CBD as a Schedule I drugs under the U.S. Controlled Substances Act.

By trying to classify both THC and CBD as a Schedule I drug, they both would have no currently accepted medical use and a high potential for abuse.

Since CBD’s effects when being used does not create the “high” or mind-altering effect, it does not fall under the same laws and legislative restrictions as marijuana does. Therefore, CBD is considered to be legal on the federal level in all fifty states.
